Regulation is the Regulation of the Minister of Transportation (Permenhub) No. 108 of 2017 on the Implementation of Transport People with Public Motor Vehicles Not In Route.

This regulation was officially valid from February 1, 2018. The Ministry of Transportation (Kemenhub) will initially enforce sympathetic operation enforcement of this rule on 1-15 February 2018. But, after a mass demonstration of the Online Drivers Alliance Online (ALIANDO), the period of sympathetic surgery will be extended by an undetermined time limit. Sympathetic surgery will only give warning to violators of this rule.

MTI Chairman Danang Parikesit considers the issuance of Permenhub 108/2017 is the government's effort to provide legal umbrella to the existence of online taxi as one of public transportation service. In addition, this regulation also ensures the protection of consumers.

He believes the issuance of Permenhub is a step forward from the government. But, according to Danang, the government needs to do careful planning for its implementation. He pointed out, for the supervision of the enforcement of this rule, need the readiness of the Central Government and Local Government.

"The local government must know the basic concept (Permenhub) requires a higher skill, ability and capacity in delivering the information, so it is not only the task of the Central Government," Danang told Tirto on Wednesday (31/1/2018) .

Local government readiness is also not only important in terms of regulatory oversight and enforcement. Danang said the local government is also important to ensure one of the implementation goals of Permenhub 108/2017, ie reducing the potential of conventional taxi driver convention online, is reached.

"As for the quota (the number of online taxi vehicles), the local government can gauge the needs of its people," said Danang.

He added that the government does not need to spend too long for the implementation of the sympathetic operation period of Permenhub 108/2017. "The government has given enough time to adapt to the regulation so that if it is to be implemented it is done again, it will return to the government's credibility as soon as the regulation will be binding on all parties," he said.

He explained that the basic concept of Permenhub 108/2017 is to ensure the safety of the users or the general public, and not just accommodate the interests of businessmen and taxi drivers online and conventional. The principle, according to him, should be really socialized by the government, both to the public and taxi drivers online.In addition, Danang suggested a number of technical problems in the implementation of Permenhub 108/2017 immediately resolved. For example, a number of technical problems are still at issue by the online taxi drivers associated with SIM A General, KIR Test, and quota and restrictions on the area of ​​online taxi operations.

According to him, these provisions are important to apply because it becomes a form of standardization that aims to ensure the safety of consumers of online transportation. To answer the complaints of the taxi drivers online about a number of provisions, Danang hopes the government immediately find a middle ground. "(Problem) This technical should not hinder (implementation) of this basic concept (Permenhub 108/2017)," he said.

He gave an example, the provision on the quota of the number of online taxis impossible to remove because it serves to ensure fair competition in the business sector of transportation.

"Thus, the service area is regulated, the competition among operators needs assertiveness," he said. "We do not want businesses to fall and the community is not served, so there's a lot to be taken care of."

Danang suggests the determination of the number of online and conventional taxi quota in each region using the main footing needs of the community.
